Contrary to stories making the rounds in the social media that Nollywood “bad” boy, James Ikechukwu Asomugha aka Jim Iyke, was left off the look in the N15million scam unscratched, court records made available to  National Life by Mr Solomon Agbo revealed that the controversial actor was only discharged but not acquitted by the Abuja chief magistrate court.
Jim Iyke was arraigned before the court on November 10, 2011 for allegedly fleecing Abuja society Lady, Hajia Habiba Abubakar of the sum of #15 million.
According to the initial police prosecutor, Mr Chijoke Okezie, Habiba petitioned the Inspector General of Police on August 8, 2011 to investigate  the fraud, accusing Jim of deceiving her into acquiring 15% equity in his company, Untamed Records Ltd and as soon as the money was paid into his account, the actor converted the money to his personal use, and went on a shopping spree.
The petitioner further said the accused resorted to beating her and threatened to kill her when she requested for her money.
The police said that Jim had admitted that the money was truly paid in his Oceanic Bank Account 00500173691 after three different statements with two days beaten and arrested in their custody before he confessed to actually collecting the money from Abubakar, when confronted the actor beat her up and threatened to kill her.
He was therefore charged with criminal breach of trust, criminal force, assault, cheating and criminal misappropriation which controverted sections 312, 265, 322, 397 and 309 of the level code. The actor pleaded not guilty to the charges then. While Habiba was preparing to mount the witness box said SOLO, Jim, his family and friends went on their knees to beg the nominal complainant, Hajia Habiba to withdraw the case and forgive the controversial actor.
On 8th May this year, Jim Iyke signed a debt repayment agreement, with the Hajia Habiba and promised to re-pay the #16,500,000 in monthly installments within four years.
According to the agreement, Jim is to make equal monthly installment which shall not be less than #200,000 into two Fin bank plc accounts of her children and he has started paying in that account on the 28th May, 2012.
Nkechi Valeria Okelue of Sunny vale Estate was Jim’s witness while Hajia Habiba’s husband was her witness.
In addition, Jim also published public apologies in two national newspapers, national life, Vanguard and daily trust of the 16/4/2012.The apology reads, “I Jim Iyke hereby sincerely apologies (SIC) to Mrs HabibaAbubakar, her family as well as members of my family for my conduct of the 10/09/2011 which has caused severe embarrassment to Mrs Habiba Abubakar personally and lead (sic) to the case she instituted against me in an Abuja magistrate court Wuse zone 6. After the involvement of my family, we have decided to settle the matter out of court. Yours sincerely, Jim Iyke.”
Few days after the matter was withdraw from court and the accused discharged, Jim has
allegedly gone on the social network media announcing that the case was thrown out because of lack of evidence against him which the police are angry about and called Hajia that they can re-instate the case if he continue saying no evidence against him, since it was the over whelming evidence against him that made him ran to apologise and asked for out of court settlement.
Although his layer, Barrister Esther Uzoma denied the involvement of her client in the complete misrepresentation of what transpired in court, she confirmed that Jim made application for out-of-court settlement.
“Jim did not post anything on the internet,” she insisted.
But the angry police would not know of that. They believed Jim deliberately posted the “lie on the internet so that those who have been careful in dealing with him will start trusting him having gone to Gambia to ask Esther the Nigerian Ambassador to book appointment with the Gambian president because he has a business proposal to see him with because most Nollywood directors do not want to do business any longer with him said Solomon Aboh”.
Mr. Solomon Aboh who displayed the letter from her lawyer, Barrister James O Idih the two published public apologies in two national newspapers, the debt repayment agreement and Certified True Copies, CTC, of court records, insisted that ; “Jim was only discharged but not acquitted!”. Mrs. Abubakar will not join issues with the mad man, street fighter, woman beater and fraudster any longer anywhere. She hopes he pays her, her money quickly, if he is claiming getting a multi-million naira deal from where ever to save himself from further embarrassment and pay it upfront. Because truly, Mrs. Abubakar does not wish to be tied down with Jim Iyke for four years.
I Solo call on Jim ‘s family  and friends to call him to order and warned him to desist from posting  lies on the internet.
Legally, I say the case could be re-listed anytime within the next two years stressing that those who love the Nollywood Star should counsel him properly.
We are waiting for the Nollywood actor to continue his payment quietly because when he fails, he will not cry or send his parents crying to Abubakar, that the law will take its full force on him. This publication is going to be the last publication anybody from Habiba’s office will do about this issue. Let Jim Iyke continue trying to save his face because a drowning man catches even a straw.
